Payment options at the clerk's window include cash, money orders, certified checks, and credit or debit cards in most cases.

The County Clerk Emily VanWorth works from the same courthouse at 300 East Duke Street and can be reached at (580) 326-5331. While the County Clerk mostly handles land records and official documents, her office does keep some records that cross over with criminal matters. Property liens from restitution orders and judgment records can show up in the County Clerk's files. If you need a certified copy of a criminal judgment or disposition from Choctaw County, the court clerk's office is the right place to start. Under Title 51 O.S. Section 24A.5, copy fees cannot exceed 25 cents per page for standard documents and one dollar per page for certified copies.

The courthouse has kept records going back to the early 1900s. Older files may need more time to pull.

Two free systems let you look up Choctaw County criminal history court records from your home. The Oklahoma State Courts Network lets you search by party name, case number, or filing date. Criminal case types use codes like CF for felony and CM for misdemeanor. OSCN is run by the Oklahoma Supreme Court. It costs nothing to use. Records go back to the mid-1990s for most courts, though some Choctaw County cases may not appear until later years.

You can pull up the OSCN docket search to see all Choctaw County court records filed in the district court system, and that includes criminal cases with their current status and hearing dates.

Choctaw County criminal history court records search on OSCN

Not every document image is free. Some require a trip to the clerk's office in Hugo.

On Demand Court Records is a separate system that also covers Choctaw County cases. ODCR updates close to real time. You can search by court, party name, or case number. The site has both free basic results and paid access to more detailed records. ODCR is a private service, not a government site, but it pulls data straight from the court. Some cases show up on ODCR but not OSCN, so it helps to check both if you need a full picture of someone's Choctaw County criminal history.

Note: Sealed records, juvenile cases, and confidential filings do not appear in any public search on OSCN or ODCR.

The OSBI CHIRP portal runs statewide criminal history searches that include Choctaw County arrests. A name-based search costs $15.00. You need the person's first name, last name, and date of birth. CHIRP searches three years before and after the date of birth you enter. That catches records with minor data entry errors. You can add a sex offender registry search for $2.00 and a violent offender search for $2.00. There is a $1.00 online fee per transaction. Most results come back fast. Some need OSBI staff review during business hours, Monday through Friday, 9:00 AM to 4:00 PM.

Keep in mind that the OSBI database only covers Oklahoma. It does not include arrests from other states or federal cases. Arrests where fingerprints were not taken will not show up at all. For a more precise search, you can submit fingerprints to OSBI at 6600 North Harvey Place, Oklahoma City, OK 73116. Fingerprint-based searches cost $19.00 and give better identification than name-based lookups. Call (405) 848-6724 for questions about criminal history searches. The Choctaw Nation has its own court system that handles certain criminal matters involving tribal citizens, and those records will not appear in the OSBI database or on OSCN.

Some search requests that take a lot of staff time may cost $10 to $25 per hour for the research.

The OSBI charges $15.00 for a name-based search through CHIRP and $19.00 for a fingerprint-based search. You can pay with a credit card or electronic funds transfer online. The Choctaw County Sheriff's Office can be reached at (580) 326-2130. The office is at the courthouse in Hugo. The sheriff keeps arrest records, booking logs, and inmate information. You can call the jail to ask about current inmates. Written requests for jail records should include the person's name, aliases, date of birth, date range, and the charge you are asking about. Booking logs are available to the public under Oklahoma's Open Records Act.

The Hugo Municipal Court handles traffic and city ordinance violations separately from the district court. Records from Hugo Municipal Court can be accessed through the city clerk's office. Fines and payments for municipal cases go through the municipal court, not the county court clerk. Appeals from municipal court cases go up to the Choctaw County District Court. If someone was arrested by Hugo police and charged with a state crime, those records transfer to the county level and become part of the Choctaw County criminal history system.

All revenue from copies printed through the online system goes to Choctaw County.

While land records are not criminal history records, the county clerk's office can help with related document searches. Property liens from criminal restitution orders and judgment records may appear in the land records system. Under the Oklahoma Open Records Act, you do not have to explain why you want records. The office cannot ask for your reason unless another law requires it. Oil and gas leases, deed recordings, and property transfers are also recorded with the County Clerk. The Choctaw Nation has historical significance in this area, and some older records may reference tribal land allotments.

Clearing Choctaw County Criminal History

Oklahoma law allows some criminal records to be sealed. Under Title 22 O.S. Section 18, a full expungement seals both court records and the OSBI arrest record. Section 991c covers deferred sentences where the plea gets expunged after probation, but the arrest record stays with OSBI. Filing fees run $100 to $300 in Choctaw County. OSBI charges a $150 processing fee on top of that. Violent felony convictions cannot be expunged under Title 57 O.S. Section 571.

Free legal help is available for people who qualify. Legal Aid Services of Oklahoma helps with expungement cases for people who meet income guidelines. Call the intake line at (888) 534-5243 or apply online. Legal Aid does not handle criminal defense but can help seal old records. The whole process takes several months to over a year from filing to final order.
